Introduction

Delaware's Attorney General, the State's chief law enforcement officer, has a broad responsibility to combat crime, uphold civil rights, safeguard families, fight fraud, and protect consumers in the First State. In meeting this mission, Attorney General Kathy Jennings is supported by teams of talented lawyers and staff in the Criminal, Civil, Family, Fraud and Consumer Protection, and Civil Rights and Public Trust Divisions. Each of the more than 500 staff who work in the Office of the Attorney General are dedicated to serving all Delawareans with integrity and passion. Deputy Attorneys General, with critical support from criminal special investigators, victim service specialists, paraprofessionals, and administrative staff, prosecute criminal cases, enforce consumer laws, provide counsel to state agencies, ensure the public's access to open government, protect the abused, and much more.

Summary Statement

The Delaware Department of Justice is seeking a Deputy Attorney General (“DAG”) to join its Fiscal Integrity and Protection Unit (“FIPU”), Civil Division, to represent the Office of Management and Budget (“OMB”) and its divisions.

Preferred Qualification

Applicants who do not possess the preferred qualification will still be eligible to compete for this position if job requirements are met.

  • The most qualified candidates will be proficient in contracting and procurement and will have prior litigation and general counsel experience.


Essential Functions

The successful candidate will serve in a general counsel role and will be assigned to represent OMB, the OMB Director, Government Support Services (central contracting), Fleet Services, Office of State Planning Coordination, the Budget Development and Planning Office, and Payroll Human Resources System Technology (PHRST). The work will include central contracting and procurement; drafting and reviewing legislation and regulations; drafting, revising, and reviewing contracts and requests for proposals and MOUs; providing guidance with respect to Freedom of Information Act (FOIA) requests and Human Resources issues: representing OMB or its divisions and/or officers and employees in court and administrative proceedings; and advising on compliance with applicable state and federal laws and regulations. The DAG will handle additional assignments as directed by the State Solicitor, Deputy State Solicitor, Unit Head, or Assistant Unit Head.

Job Requirements

The most qualified candidates will be proficient in contracting and procurement and will have prior litigation and general counsel experience, though such experience is not required for selection. FIPU takes a proactive approach to assisting its clients, therefore a successful candidate should have the ability to work with client officers and staff to identify and address potential issues and assist State agencies minimize risk and liability and avoid litigation. The DAG should be able to work independently and meet deadlines, with demonstrated legal ability and thorough knowledge of relevant laws and court rules. Membership in Delaware Bar is required.
